HC warns Kerala Govt on transport strike
Kochi: Kerala High Court today warned the State Government that the court would have to intervene if it kept silent in dealing with the private carriages on strike in Kerala.
A Division Bench comprising Chief Justices S R Banhurmath and Thottathil B Radhakrishnan observed it would do as it was eminently required in terms of the Constitution and laws, having regard to the public interest involved.
The Court also observed the granting of permit to ply private carriage also was coupled with the duty to ensure that the trips were appropriately operated.
The violation of it could result in situations where the permit could be cancelled. Without appropriate transport system, Article 19 and 21 of the Constitution would stand obliterated.
There could be no situation holding the public to ransom.
These observations were made by the High Court while considering a PIL filed by FAST seeking a direction to invoke the Essential Services Maintenance Act against the striking bus operators.
